1. Our Deal Together

By entrusting us with your goods to sell, you're agreeing to our terms. If we receive your goods along with a filled-out Consignment Service Form, these terms apply. They take effect once we get the goods you want to sell, which remains your responsibility until we have them in good, sellable condition. Read these terms carefully before sending us your goods. If unclear or you want changes, let us know within 24 hours of our confirmation.

 

2. Who We Are

We are HYPE23 LTD T/A Hype23 and Kicks23 a company registered in England and Wales. Our company registration number is 14383638 and our registered office is unit D2 Eldon Gardens, Newcastle, NE1 7RA

2.3 How we may contact you. 

If we have to contact you we will do so by telephone or by writing to you at the email address or postal address you provided to us in your order or the consignment service form completed by you.

2.4 Writing includes emails. When we use the words "writing" or "written" in these terms, this includes email. 

 

3. The Deal in Detail

You want us to sell your goods on your behalf. We provide that service after we receive a Consignment Service Form from you along with the goods (in sellable Condition). The price we set is the Listing Price. You may ship the goods to us, and if they meet our standards, we will list them on our site. If they don't make the cut, we can dispose of them or return them for a fee of £29 to cover our shipping, packaging and admin fees . The goods remain with us until they're sold and paid for.

 

We are under no obligation to accept the Goods, nor are we obliged to carry out any Services under these terms, if it is deemed that the Goods do not meet the standards required by our authentication process.

 

Upon sale of the Goods to our Customer, we will send the proceeds of the Goods, less the Consignment Fee and any expenses (including but not limited to any PayPal or banking fees) upto twenty eight (28) days from the date at which the buyer of your item(s) receives the item, but no less that fifteen (15) days. If the buyer returns the item payment to you will be cancelled and the consignment term continues. You must provide payment terms with your consignment form which cannot be changed. 

 

For used products a cleaning and restoration fee will be payable at the time of handing the goods over or an invoice will be sent to items posted to us. Without payment in advance your goods will not be listed and our services will not commence. 

 

4. Delivery of the Services

Our service begins once we accept your goods, if they meet our quality standards, and we work to sell them to our customers. If we can't fulfill our service due to unforeseen circumstances or discrepancies on our part, we'll let you know and you won't have to pay us.

 

5. Ending the Service

You can stop our services anytime by letting us know through email. Once received, we will make your unsold goods available for collection within five Business Days. There's a withdrawal fee of £35 if you do this within 30 days of agreement.

 

6. When We Can End the Service

We have the right to stop the service if you breach our agreement or we choose to stop providing the service.

 

7. Setting the Price

The selling price, or Listing Price, will be on the Consignment Service Form, unless we agree on another price. We will do our best to sell the goods at the listed price.

 

8. Privacy and Your Personal Information

8.1 We'll use the information you give us to:

(a) Deliver our service to you

(b) Handle your payment for our service

(c) Let you know about similar services we offer. You can opt out of these messages at any time by reaching out to us.

8.2 We will only share your personal information with others if we legally have to.

 

9. Liability

You shall hold harmless, indemnify, and defend us and our parents, officers, directors, partners, members, shareholders, employees, agents, affiliates, successors and permitted assigns against any and all losses, damages, liabilities, deficiencies, claims, actions, judgments, settlements, interest, awards, penalties, fines, costs, or expenses of whatever kind, including legal fees, fees and the costs of enforcing any right to indemnification under this Agreement and the cost of pursuing any insurance providers incurred by an Indemnified Party arising out of relating to, or resulting from any claim, action, cause of action, demand, lawsuit, arbitration, inquiry, audit, notice of violation, proceeding, litigation, citation, summons or investigation of any nature, civil, criminal, administrative, regulatory or other, whether at law, in equity or otherwise of a third party: (i) relating to a breach of any representation, warranty or covenant made by you un this Agreement; (ii) alleging or relating to any act or omission by you in connection with the performance of your obligations under this Agreement; (iii) alleging or relating to any bodily injury, death of any person or damage to real or tangible personal property caused by your acts or omissions or (iv) relating to any failure by you to comply with any applicable laws.

 

10. You agree to protect us against any costs, charges, damages, or legal actions that might be brought against us because of you breaking this agreement, doing something (or not doing something) you should have done, any damage caused by your actions, or failure to follow applicable laws.

  

11. Terms About This Agreement

We may pass this agreement to another party. We will let you know if this happens and your rights will not be affected. This agreement is just between us and you - no one else has rights to enforce it. If a court finds any part of this contract illegal, the rest of it will still be valid. If we don't enforce our agreement immediately when it is broken, we can still choose to enforce it later. English law governs these terms. Legal proceedings for our services can be brought in English courts. For residents of Scotland and Northern Ireland, proceedings can be in either the Scottish, Northern Irish, or English courts
